本文探讨了配套公建的界定、配套公建的产权归属与争议处理,以及配套法律法规的发展趋势等问题,以期为相关问题的处理提供借鉴。
上述规范涉及的配套公建用途范围广泛,涵盖了市政、教育、卫生、商业、社区服务等多个领域,最常见的有幼儿园、医院、物业用房、公厕、邮局、便利店等,不同类别中所包含的项目名称可以参考《城市居住区规划设计规范》(GB50180-2018)的附录B中规定的内容,具体如下:
2020年9月9日,自然资源部对十三届全国人大三次会议第3226号建议作出答复,该答复第二条指出“关于全体业主共有的不动产登记问题。《物权法》《不动产登记暂行条例实施细则》对建筑物中全体业主共有部分办理不动产登记的要求、申请材料等进行了明确规定。按照“物权法定、权利设定和登记确权”的原则和程序,全体业主共有的不动产范围应当在建设工程规划中予以明确,在建设工程规划审批和实施时严格落实,避免开发商留有部分房产、出现产权模糊,在此基础上,依法开展登记,明确产权归属、定纷止争。”
从上述答复中可见,国家层面已经注意到配套公建的权属争议问题,并要求对权属进行明确,虽然其中并未指出哪些配套公建属于业主共有,但可以预见,将会有一系列规章甚至法规、法律出台,直接规定属于业主共有的配套公建的范围。
从当前的规范体系来看,除市政公用部分外的配套公建,是否归全体业主所有尚存争议,房地产开发商亦可在房屋买卖合同中通过明确约定产权的方式来排除业主共有的范围,明确产权,但这本身其实并非问题所在。
实质的问题所在有二:
其一,配套公建问题不透明不公开,进而影响了正常的市场化价格竞争。根据上述分析可知,配套公建的权属实际应与业主的购房价格相关,但开发商并未充分披露,购房者也并不知情,如此,造成了不同开发商各自制定销售策略和价格安排,造成了市场的不透明,进而对买房者甚至部分开发商(市场竞争角度)的不公平。
其二,配套公建问题不透明不公开,进而影响了房屋品质的提升,阻碍房产市场健康发展。建设配套公建的目的是为了提高小区生活品质,为小区居民的生活提供各种便利条件。但鉴于产权与价格关系的隐晦特点,开发商为提升价格竞争力,则会考虑降低生产成本即减少配套公建的建设,因此造成房产品质的竞争性下降。
综上所述,公建产权问题不只是法律问题,还是市场问题,简单的颁布关于权属的规定可能无法解决根本,无论是政府还是开发商,均应考虑房产市场的健康发展,从合同条款的规范性角度予以调整,更为适宜。
