“Civil code era: paths out for distressed enterprises and legislative consummation” conference successfully held in Zhengzhou

Sponsored by the Economic Law Research Society of Henan Law Society, Bankruptcy Law Research Society of Henan Law Society, Beijing Bankruptcy Law Society, and undertaken by Kangda Law Firm Zhengzhou Branch, the “Civil code era: paths out for distressed enterprises and legislative consummation” conference was successfully held in Sheraton Grand Zhengzhou Hotel on 28 Apr.2021.

This conference focused on the background of the promulgation and implementation of the Civil Code and discussed the problems related to the path out for distressed enterprises and the perfection of legislation, by which, providing research and collecting suggestions for the expansion of financing channels for China’s SMEs, risk response, bankruptcy law and related legal amendments, and business environment optimization.

Qiao Jiaping, Director of the Management Committee of Kangda Law Firm (KLF) attended the conference and gave a speech. Director Qiao spoke highly of the gathering of experts and scholars to study the problems related to the paths out for distressed enterprises. Since its inception over thirty years ago, KLF has always committed to the attention and resolution of social hotspots and difficulties and has the balance of social justice and case justice, and the pursuit of the construction of the rule of law. Under macro guidance and unified leadership of the headquarters of KLF, KLF Zhengzhou branch would base in Henan province, focus exclusively on litigation in central China and constantly contribute the wisdom of Kangda lawyers to the new development of Henan's rule of law, economy and culture.

Zeng Deya, Executive Deputy Minister of the Propaganda Department of Henan Provincial Party Committee, sent his written speech. He sent his warm congratulations to the conference and sincere welcome to all experts and scholars participating in the conference on behalf Propaganda Department of the CPC Henan Provincial Committee. He hoped that all experts would actively advise and offer suggestions focusing on the paths out for distressed enterprises, well implement the civil code and create a good business environment.

The conference also invited scholars, judges, lawyers, administrators and other members of the legal professional community. Over five hundred guests attended the conference.

Professor Wang Liming, Vice President of the Chinese Law Society, President of the Civil Law Research Association of the Chinese Law Society, first-class professor of the Renmin University of China and Ph.D. supervisor, delivered a keynote speech on "Modernization of Security interests System and Highlights of China’s Civil Code".  Professor Wang Liming first pointed out that the modernization of the security system is related to the development of the entire market economy. The civil code conforms to the development trend of security interests and we should establish legislative thinking and respect the law. Next, Professor Wang systematically discussed the development trend of the security property rights system from aspects such as the development trend of movables security, unified priority rules for the competitive existence of security interests, expansion of the scope of secured property, and expansion of party autonomy. Professor Wang Liming's speech was highly recommended and widely cited and aroused warm applause from the guests.

Wang Xinxin, President of Beijing Bankruptcy Law Research Association, Director of Bankruptcy Law Research Center of the Renmin University of China Law School, Professor of Renmin University of China and Ph.D. supervisor, delivered a keynote speech on“Discrimination and Analysis of System Construction and Practice on prepackaged reorganization”. Professor Wang Xinxin systematically introduced the concept and basic characteristics of prepackaged reorganization, the correct understanding and implementation of the prepackaged reorganization and the in-depth thinking on the construction of China's prepackaged reorganization from the perspective of the problems and countermeasures in the legal system of corporate rescue. Professor Wang Xinxin interpreted the law with cases and the whole speech was full of wit, which benefited the guests.

“Civil code era: paths out for distressed enterprises and legislative consummation”conference was divided into 2 topics: Legislative perfection in the perspective of the legal business environment and the limitation and optimization of the path of distressed enterprises from the perspective of bankruptcy law practice. The experts and scholars from universities, courts and law associations who participated in the conference discussed the two topics above and expert Wang Xinxin, Wang Yuhui, and Kangda senior partner Peng Wei respectively made detailed comments.

With the warm applause of the guests, the conference ended successfully. It is the glorious mission of the legal professional community to implement Xi Jinping's thoughts on the rule of law, promote the spirit of the Civil Code, and create a stable, fair, transparent, and predictable business environment. This conference focused on the issues related to the methods of helping distressed enterprises. Experts and scholars in the industry actively offered their advice and suggestions, which was conducive to stimulating all kinds of market entities to concentrate on entrepreneurship, investment and operation, and gathering strong strength for the construction of modern society.
